Service Agreement

By creating an account, using our website or app, uploading information, approving your tax return, or asking us to lodge your tax return, you agree to this Service Agreement.

1. Who this agreement is between

This agreement is between:

Tax IQ: Tax IQ Enterprise Pty Ltd (ABN 77 691 414 945)

You: the person or client using Tax IQ.

In this agreement, "we", "us" and "Tax IQ" means Tax IQ. "You" means the customer.

2. What Tax IQ does

Tax IQ helps eligible Australian individuals prepare and lodge their tax return online with support from our team.

  • pre-filling your income and tax details from the ATO where available;

  • asking you questions to help identify possible deductions;

  • checking your information before lodgement;

  • preparing your tax return;

  • showing you your estimated refund or tax payable;

  • lodging your return with the ATO after you approve it;

  • storing receipts and supporting documents you upload;

  • helping with eligible amendments within 12 months after lodgement; and

  • helping with ATO questions, reviews or audits relating to the tax return we lodged for you, for up to 12 months after lodgement.

We aim to make tax simple, clear and low-stress. We do not provide financial planning, investment advice, legal advice or credit advice.

3. Who Tax IQ is for

Tax IQ is currently designed for simple individual tax returns, especially PAYG employees and young workers.

At this stage, our platform does not support all tax situations.

Unless we agree otherwise in writing, Tax IQ is not currently suitable for you if your tax return includes:

  • investment properties;

  • sole trader income;

  • foreign income or foreign tax issues;

  • deceased estate matters;

  • complicated residency issues; or

  • any other matter we consider too complex for the online service.

If we discover that your return is outside our supported scope, we may pause, decline or cancel the service. If you have already paid, we will let you know whether you are eligible for a refund based on how much work has already been completed.

4. Your authority for us to act

When you use Tax IQ and ask us to prepare or lodge your tax return, you authorise Tax IQ and our authorised team members or consultants to act for you in relation to the tax services you request.  

This may include authority to:

  • access information from the ATO;

  • review your income statements, prefill data and tax details;

  • ask the ATO questions about your tax affairs;

  • prepare your tax return;

  • lodge your tax return;

  • communicate with the ATO about the tax return we lodged for you;

  • prepare and lodge an amendment if required and agreed; and

  • assist with ATO queries, reviews or audits relating to the return we prepared.

5. What you need to do

You are responsible for giving us complete, accurate and up-to-date information.

You agree to:

  • answer our questions honestly;

  • check that your personal details, income, deductions and bank details are correct;

  • upload or keep evidence for any deductions you claim;

  • tell us if anything is missing, wrong or has changed;

  • respond to our requests within a reasonable time;

  • not claim expenses you did not incur or cannot substantiate;

  • not use Tax IQ for anyone else's tax return unless we allow it; and

  • approve your tax return only when you are satisfied it is correct.

Australia's tax system is based on self-assessment. This means the ATO may rely on the information in your return. If the information is wrong, incomplete or unsupported, the ATO may amend your assessment, reduce your refund, require repayment, or apply penalties and interest.

6. ATO prefill information

We may use ATO prefill information to help prepare your return. Prefill information can be helpful, but it may not always be complete, current or correct.

You are responsible for checking the information before approving your return. If you know something is missing or incorrect, you must tell us before lodgement.

7. Deductions and receipts

We may help identify deductions you may be eligible to claim. However, we cannot guarantee that the ATO will accept every deduction.

You are responsible for making sure each deduction is true, work-related where required, not already reimbursed, and supported by records.

You are required by law to keep records for the necessary period, usually 5 years.  However, where you upload receipts or documents to Tax IQ, we will store them for the required period so long as you remain a current client of Tax IQ as per the tax agent portal and where our platform supports storage.

8. Your approval before lodgement

Before we lodge your tax return, we will show you a summary of the return and ask you to approve it.

By approving your tax return, you confirm that:

  • you have reviewed the return;

  • the information is complete and accurate;

  • you have evidence for your claims;

  • you understand your estimated refund or tax payable may change after ATO processing; and

  • you authorise us to lodge the return with the ATO.

Once lodged, changes may require an amendment.

9. Pricing and payment

Our standard fee is the price shown to you on the website or app for an eligible individual tax return, unless another price is shown to you before payment.

The fee covers preparation, review and lodgement of one eligible tax return through Tax IQ.

We may charge extra, or decline the service, if:

  • your tax return is outside our supported scope;

  • you ask for additional services not included in the standard service; or

  • your matter requires specialist advice.

Any additional fee will be shown to you before we proceed.

10. Refunds

If we cannot provide the service because your tax return is outside our supported scope, we may refund your fee if we have not already substantially prepared your return.

We do not provide a refund just because:

  • your tax refund is lower than expected;

  • the ATO changes your assessment;

  • you owe tax;

  • you change your mind after we have started work; or

  • the delay is caused by missing, late or incorrect information from you.

Your rights under the Australian Consumer Law are not excluded.

11. Tax IQ Guarantee

Tax IQ is designed to give you confidence that your tax return has been prepared carefully and that you are claiming the refund you are legally entitled to.

For tax returns prepared and lodged by Tax IQ, our guarantee includes:

  • Maximum refund guarantee: if, within 12 months after lodgement, you identify a missed deduction, claim or error that would have legally increased your refund or reduced your tax payable, we will help prepare and lodge an amendment for free.

The Maximum Refund Guarantee only applies where the missed deduction, claim, error or issue was within Tax IQ’s supported service scope agreed at the time we lodged your original return. It does not apply if the amendment requires us to include or review matters outside that scope, including investment properties, sole trader income, business income, employee share schemes, foreign income, residency issues, complex capital gains tax events or other complex tax matters.

The Maximum Refund Guarantee does not guarantee a specific refund amount or that the ATO will accept every claim. Your refund depends on your income, tax withheld, Medicare levy, HELP/HECS debt, offsets, ATO processing, ATO decisions and other tax factors.

  • Free error fixing: if we make an error in preparing your return and you tell us within 12 months of lodgement, we will help fix it for free.

  • Free amendment support: if an amendment is required, we will help prepare and lodge the amendment for free within 12 months of lodgement, provided the amendment remains within Tax IQ’s supported service scope agreed to at the time we lodged your original return.

The free amendment support only applies to eligible individual tax returns within Tax IQ’s supported service scope. It does not apply if the amendment requires us to include or review matters outside that scope, including investment properties, sole trader income, employee share schemes, foreign income, residency issues or other complex tax matters.

  • ATO review and audit assistance: if the ATO contacts you about a return Tax IQ lodged for you, we will provide reasonable assistance for up to 12 months after lodgement.

This may include helping you understand the ATO request, reviewing the relevant return, helping you locate documents uploaded to Tax IQ, and assisting with responses relating to the return we prepared.

This support does not include:

  • legal representation;

  • court or tribunal proceedings;

  • advice from external lawyers or specialists;

  • disputes unrelated to the return we lodged;

  • fraud, evasion or intentionally false claims; or

  • work outside our supported service scope.

  The Tax IQ Guarantee only applies where you provide complete and accurate information, are legally entitled to the claims made, and have records to support those claims where required. None of the guarantees apply to any claim, issue or amendment that involves fraud, intentional wrongdoing, misleading or incomplete information, unsupported claims, or any matter that would be unlawful or inconsistent with Tax IQ’s professional obligations.

14. Security and privacy

We take privacy and security seriously. We use technical, organisational and administrative safeguards designed to protect your personal and tax information.

You are responsible for keeping your login details secure and for telling us immediately if you suspect unauthorised access to your account.

We handle personal information in accordance with our Privacy Policy. By using Tax IQ, you consent to us collecting, using and disclosing your information as reasonably necessary to provide the service, verify your identity, communicate with the ATO, process payments, manage support, comply with law, and improve Tax IQ.

15. Platform access

We aim to keep Tax IQ available and working smoothly, but we do not guarantee that the website, app or service will always be uninterrupted, error-free or available at a particular time.

We may update, suspend or restrict access to the platform for maintenance, security, compliance, operational or legal reasons.

You must not misuse the platform, attempt to bypass security, scrape data, upload harmful code, impersonate another person, or use Tax IQ for unlawful purposes.

16. Intellectual property

Tax IQ owns or licenses the content, design, software, processes, branding, templates and other intellectual property used in the platform and service.

You may use Tax IQ only for your personal tax return. You must not copy, modify, reverse engineer, resell, or use our platform or materials to provide services to someone else.

You retain ownership of the information and documents you provide to us. You give us permission to use that information as needed to provide the service and comply with our legal obligations.

17. Limitation of liability

To the maximum extent permitted by law, Tax IQ is not liable for loss or damage caused by:

  • incomplete, incorrect or late information provided by you;

  • deductions or claims that are not accepted by the ATO;

  • ATO delays, decisions, penalties or interest;

  • your failure to keep records;

  • unauthorised access caused by your failure to protect your login details;

  • outages or issues caused by third-party systems;

  • matters outside our supported service scope; or

  • events outside our reasonable control.

Where our liability cannot be excluded, our liability is limited, to the extent permitted by law, to supplying the service again or refunding the fee you paid for the affected service.

Nothing in this agreement excludes rights that cannot be excluded under the Australian Consumer Law or other applicable laws.

18. Tax agent registration and professional standards

Tax IQ's tax services are provided by or under the supervision of a registered tax agent.

Registered tax agents must comply with the Tax Agent Services Act 2009, the Tax Agent Services Code of Professional Conduct, and applicable professional obligations.

You have rights as a taxpayer, including rights to object to certain ATO decisions, seek review, and request private rulings where available. Time limits may apply.

Tax IQ may be covered by professional indemnity insurance and, where applicable, liability may be limited by a scheme approved under Professional Standards Legislation.

19. When we can pause or stop the service

We may pause, cancel or refuse to provide the service if:

  • your return is outside our supported scope;

  • you do not provide information we need;

  • we believe information is false, misleading or unsupported;

  • you do not respond to reasonable requests;

  • you misuse the platform;

  • you do not pay the required fee;

  • providing the service would breach our legal or professional obligations; or

  • we consider there is a conflict of interest or unacceptable risk.

If we stop providing the service, we will tell you where reasonable to do so.

20. Ending this agreement

You may stop using Tax IQ at any time.

If this agreement ends for any reason, Tax IQ may stop providing the service immediately. This includes access to the platform, document storage, amendment support, ATO review or audit assistance, customer support, and any other ongoing service or assistance.

Ending this agreement does not affect any rights or obligations that arose before termination, including payment obligations, confidentiality, privacy, intellectual property rights, liability limits, and any legal or regulatory obligations that apply to you or Tax IQ.

21. Changes to this agreement

We may update this Service Agreement from time to time. The latest version will be available on our website.

By continuing to use Tax IQ after the updated terms are published, you agree to the updated terms.

22. Governing law

This agreement is governed by the laws of New South Wales, Australia.

You and Tax IQ submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
